Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Mithrel iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a legal agreement between you and Mithrel ("we", "us", or "our"). We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Mithrel. By using the App, you represent that you meet this age requirement.

If you are using the App on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Your Account

You may sign in using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity under it.

You agree to provide accurate information and to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

You may not create multiple accounts, share your account, or use another person's account without permission.

4. Acceptable Use

You agree not to use Mithrel to:

• Post content that is illegal, defamatory, harassing, threatening, or invasive of another person's privacy
• Post content that infringes the intellectual property rights of others
• Impersonate any person or entity
• Upload malware, spam, or any code intended to disrupt or damage the service
• Attempt to reverse engineer, scrape, or extract data from the App or our API
• Use the App in any way that violates applicable laws or regulations
• Post content that sexualizes minors or promotes violence

We reserve the right to remove content and suspend or terminate accounts that violate these rules, without prior notice.

5. Your Content

You retain ownership of all content you create and publish through Mithrel. By publishing content, you grant Mithrel a non-exclusive, worldwide, royalty-free license to display, distribute, and store that content as necessary to operate the service.

You are solely responsible for the content you publish. You represent that you have all rights necessary to post that content and that it does not violate any third-party rights.

AI-generated draft captions are suggestions only. You are responsible for reviewing and approving all content before publishing.

6. AI-Generated Content

Mithrel uses artificial intelligence (Google Gemini API) to generate draft post captions. These drafts are:

• Suggestions only — not published without your explicit approval
• Generated based on your personal data (photos, behavioral patterns) as processed on your device
• Not guaranteed to be accurate, appropriate, or complete

You acknowledge that AI-generated content may occasionally be incorrect, biased, or inappropriate. Always review drafts before publishing. We are not liable for any harm arising from AI-generated content that you choose to publish.

7. Device Permissions

Mithrel requests access to iOS system features including Photos, Camera, Apple Music, HealthKit, and Screen Time (via Family Controls). These permissions are optional — granting them enables additional features.

You may revoke permissions at any time via iOS Settings. Revoking a permission will disable features that depend on it, but will not delete your account.

8. Third-Party Services

The App integrates with third-party services including Google Sign-In, Apple Sign-In, and the Google Gemini API. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Intellectual Property

Mithrel and all of its original content, features, and functionality (excluding user-generated content) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its source code without our prior written consent.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any AI-generated content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS OR (B) $10 USD.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

You may terminate your account at any time via Profile → Settings → Delete Account. Upon termination, your account data and published posts will be deleted from our servers in accordance with our Privacy Policy.

Sections 5 (Your Content), 9 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), and 14 (Governing Law) survive termination.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
